By accessing and using the MedEase platform (website, mobile application, and any related services), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you must immediately discontinue your use of the platform.
Modification of Terms
MedEase reserves the right to modify these terms at any time. Continued use of the platform after modifications constitutes your acceptance of the updated terms. We will notify users of material changes via email or prominent notification on the platform.
Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use this platform. By using MedEase, you represent and warrant that you meet these eligibility requirements.
2. User Responsibilities
As a user of MedEase, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Registration
- You must provide accurate, current, and complete information during registration
- You are solely responsible for updating your profile information
- You agree to accept responsibility for all activities conducted under your account
- You will immediately notify MedEase of any unauthorized access to your account
Prohibited Activities
You agree NOT to:
- Use the platform for any illegal, fraudulent, or harmful purpose
- Provide false or misleading medical information
- Harass, threaten, or abuse healthcare providers or other users
- Attempt to gain unauthorized access to system resources
- Upload malware or malicious code
- Engage in any form of automated data collection without permission
- Violate any applicable laws or third-party intellectual property rights
- Attempt to undermine the security or integrity of the platform
Health Information Accuracy
You understand that the accuracy of your medical history, symptoms, and health information is critical for proper medical care. You agree to provide truthful and complete information to healthcare providers. MedEase is not responsible for medical decisions made based on inaccurate or incomplete information you provide.
3. Doctor Responsibilities
Healthcare providers on the MedEase platform have agreed to meet specific professional standards and responsibilities:
Professional Standards
- Maintain valid medical licenses and professional certifications
- Comply with all applicable medical practice regulations and HIPAA requirements
- Provide medical advice and services consistent with professional standards of care
- Maintain patient confidentiality and privacy at all times
- Respond to appointment inquiries within reasonable timeframes
- Provide accurate availability and cancellation information
Medical Care Standards
- Conduct consultations professionally and with appropriate clinical judgment
- Maintain detailed and accurate patient records
- Clearly communicate diagnoses, treatment options, and follow-up care
- Disclose any conflicts of interest or limitations of remote consultation
- Refer patients to emergency services or in-person care when medically necessary
Platform Compliance
Doctors agree to comply with all MedEase platform policies, maintain professional conduct at all times, and not engage in discriminatory practices. Any violation may result in suspension or termination of access to the platform.
4. Appointment Policies
Booking and Confirmation
- Appointments are confirmed only upon payment and doctor acceptance
- A confirmation email with appointment details will be sent immediately
- You are responsible for verifying appointment details (date, time, format)
- MedEase is not responsible for missed appointments due to incorrect information provided by you
Cancellation and Rescheduling
- Patient Cancellations: Patients may cancel appointments up to 24 hours before the scheduled time for a full refund. Cancellations within 24 hours may incur a cancellation fee.
- Doctor Cancellations: If a doctor cancels, you will be offered a full refund or the option to reschedule with another provider at no additional cost.
- Rescheduling: Both patients and doctors can request to reschedule provided sufficient notice is given (minimum 12 hours).
No-Show Policy
- If you do not attend your appointment at the scheduled time, it is considered a "no-show"
- The consultation fee will not be refunded for no-shows
- Repeated no-shows may result in restrictions on your account
- If a doctor does not appear, you will be offered a full refund or rescheduling option
Appointment Duration
Appointment times are approximate. Consultations may conclude earlier or extend beyond the allocated time depending on medical necessity. Additional time may incur additional fees at the doctor's discretion.
5. Payment Terms
Payment Processing
- Payment must be completed before the appointment is confirmed
- MedEase accepts all major credit cards, digital wallets, and insurance billing
- All prices are displayed in USD unless otherwise specified
- Payments are processed securely through encrypted connections
Fees and Charges
- Consultation fees vary based on doctor expertise, specialization, and appointment type
- Fees are clearly displayed before booking and confirmed in your confirmation email
- Additional charges may apply for prescription fulfillment or special services
- MedEase may charge administrative fees for certain transactions
Refund Policy
- Refunds for cancellations are processed within 5-7 business days
- Insurance companies may have separate authorization and payment terms
- Dispute resolution for payment issues should be initiated within 30 days
6. Limitation of Liability
Disclaimer of Warranties
The MedEase platform is provided "as is" and "as available" without warranties of any kind. MedEase does not warrant that the platform will be uninterrupted, error-free, or secure. MedEase disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
Medical Disclaimer
IMPORTANT: MedEase is a platform that connects patients with healthcare providers. The platform itself does not provide medical advice or diagnosis. All medical advice is provided solely by the healthcare provider conducting the consultation. MedEase is not responsible for:
- Medical diagnoses, treatment recommendations, or clinical outcomes
- Misdiagnosis or medical malpractice by healthcare providers
- Adverse reactions to medications or treatments prescribed
- Decisions made based on information provided through the platform
Limitation of Damages
Except as prohibited by law, in no event shall MedEase be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.
Maximum Liability
MedEase's total liability for any claim arising from or relating to these terms or your use of the platform shall not exceed the amount paid by you for the specific service in question, or $100, whichever is greater.
Emergency Services
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, PLEASE CALL 911 OR VISIT THE NEAREST EMERGENCY ROOM IMMEDIATELY. MedEase is not a substitute for emergency medical services and should not be used for life-threatening situations.
7. Termination Conditions
Termination by User
You may terminate your MedEase account at any time by submitting a termination request through your account settings. Upon termination, your access to the platform will be revoked, and your account data will be retained in accordance with our Privacy Policy and legal requirements.
Termination by MedEase
MedEase may suspend or terminate your account immediately without notice if:
- You violate any provision of these Terms of Service
- You engage in fraudulent, illegal, or harmful activities
- You provide false or misleading information
- You harass or threaten healthcare providers or other users
- You attempt to compromise platform security
- You fail to pay required fees or charges
Effect of Termination
- All rights and licenses granted to you are immediately revoked
- You must cease all use of the platform and services
- Any scheduled appointments may be cancelled
- Applicable refund policies will be honored as stated in these terms
- MedEase may retain your data as required by law
Appeal of Termination
If your account is terminated, you may appeal the decision by contacting our support team at support@medease.in within 30 days. MedEase will review your appeal and respond within 10 business days.
8. Intellectual Property Rights
All content on the MedEase platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of MedEase or its content suppliers and is protected by international copyright and intellectual property laws.
You may not reproduce, distribute, or transmit any content without MedEase's prior written permission. Unauthorized use of any content may violate copyright, trademark, and other laws.
9. Governing Law and Dispute Resolution
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New York County.
Dispute Resolution
Before pursuing litigation, you and MedEase agree to attempt to resolve disputes through negotiation and mediation. If resolution cannot be reached, you agree to binding arbitration in accordance with the American Arbitration Association rules.
10. General Provisions
Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MedEase regarding your use of the platform and supersede all prior and contemporaneous agreements.
Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
MedEase's failure to enforce any right or provision shall not constitute a waiver of that right or provision. No waiver is effective unless in writing and signed by MedEase.
